After she died on Oct. 11, 2025, at 79, some news outlets reported that she left <a href=\"https:\/\/www.finance-monthly.com\/hollywood-heartbreak-the-5-million-question-in-diane-keatons-will\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:US$5 million of her estimated $100 million estate;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">US$5 million of her estimated $100 million estate<\/a> to her dog.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">I\u2019m a <a href=\"https:\/\/law.richmond.edu\/faculty\/atait\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:law professor;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">law professor<\/a> who teaches about wills, trusts and <a href=\"https:\/\/allisontait.substack.com\/?utm_campaign=profile_chips\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:other forms of inheritance law;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">other forms of inheritance law<\/a>. Every semester, I teach my students how they can help clients provide for their pets after death. Because they, like many Americans, love their pets and want to know how to take care of them, this topic always piques their interest.<\/p>\n<h2 class=\"mb-4 text-xl font-bold md:text-2xl\">Writing pets into a will<\/h2>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">An estimated <a href=\"https:\/\/americanpetproducts.org\/news\/latest-pet-ownership-and-spending-data-from-appa-reveals-continued-strength-of-national-pet-industry-in-the-face-of-economic-uncertainty\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:66% of all U.S. households include at least one pet;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">66% of all U.S. households include at least one pet<\/a>. Many Americans consider their cats, dogs, tortoises or other animals to be part of their family, and their spending on those nonhuman relatives is immense. In 2024, they paid a <a href=\"https:\/\/americanpetproducts.org\/industry-trends-and-stats\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:total of about $152 billion;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">total of about $152 billion<\/a> for goods and services to feed and otherwise support their pets.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Taking good care of your pets can go beyond buying them treats and sweaters. It can include leaving clear directions to ensure their needs are met once you\u2019re gone. There are several ways that you can do this.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The first is <a href=\"https:\/\/theconversation.com\/want-to-do-more-for-your-favorite-charity-consider-a-planned-gift-138241\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:through your will;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">through your will<\/a>. You can\u2019t give your pet money directly in your will, because the law says that <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/166\/698\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:pets are property;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">pets are property<\/a>, like your books or your dishes.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">You can, however, <a href=\"https:\/\/www.law.cornell.edu\/wex\/bequest\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:leave a bequest;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">leave a bequest<\/a>, the technical term for a gift to a person or a cause listed in a will, to someone who will be the animal\u2019s caretaker. That bequest can include directions that the money be spent meeting the pet\u2019s needs.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">It\u2019s worth it to also name an alternate or contingent caretaker in case the first person you name does not want to or cannot take on that responsibility, or they die before you or the animals you\u2019ve provided for in the will.<\/p>\n<h2 class=\"mb-4 text-xl font-bold md:text-2xl\">Choupette\u2019s life of luxury<\/h2>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">German fashion designer, photographer and creative director <a href=\"https:\/\/people.com\/karl-lagerfeld-s-former-housekeeper-reveals-how-his-cat-choupette-lives-as-a-multi-million-dollar-heiress-11712255\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Karl Lagerfeld;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Karl Lagerfeld<\/a>, who died in 2019 at 85, was someone who made the mistake of <a href=\"https:\/\/www.bbc.com\/news\/entertainment-arts-47305450\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:leaving money directly;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">leaving money directly<\/a> to his fluffy Birman cat, Choupette. It worked out for Choupette, though.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The cat was, according to several reports, <a href=\"https:\/\/www.parisselectbook.com\/2025\/10\/07\/defile-chanel-ss-2026-entre-cosmos-et-haute-couture-au-grand-palais\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:still alive in 2025;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">still alive in 2025<\/a> and eating meals out of the porcelain bowls that Lagerfeld bought for her. Choupette is cared for at great expense and in the utmost luxury by Fran\u00e7oise Ca\u00e7ote, the designer\u2019s former housekeeper. The cat even had a <a href=\"https:\/\/www.hellomagazine.com\/celebrities\/824477\/inside-the-lavish-life-of-karl-lagerfeld-cat-choupette-exclusive\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:13th birthday party at Versailles;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">13th birthday party at Versailles<\/a>.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Another pet owner who did right by her pet was the comedian, producer and red carpet interviewer Joan Rivers.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\"><a href=\"https:\/\/www.news24.com\/life\/joan-rivers-leaves-part-of-fortune-to-her-4-dogs-20140919\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Rivers had two rescue dogs in Manhattan;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Rivers had two rescue dogs in Manhattan<\/a> and two more dogs in California when she died in 2014 at age 81. These kinds of trusts were not possible until the 1990s, because pets were not considered true beneficiaries \u2013 meaning they couldn\u2019t sue the trustee.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">But in the 1990s, states began to change their rules to allow for pet trusts. Today, pet trusts are valid in the whole country, although the <a href=\"https:\/\/www.aspca.org\/pet-care\/pet-planning\/pet-trust-laws\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:rules vary slightly;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">rules vary slightly<\/a> from state to state.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">To establish a pet trust, you or a lawyer must draw up a trust document that names two important people: a trustee and a caretaker. <a href=\"https:\/\/www.fidelity.com\/learning-center\/wealth-management-insights\/trustee-vs-executor\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:The trustee is the person who will manage the money;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">The trustee is the person who will manage the money<\/a> you leave in trust. They will make distributions to the caretaker that you select.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">You must also specify how the money is to be spent meeting the animal\u2019s needs and who would get any money that could be left in the trust when the pet dies. Typically, these trusts take effect at the owner\u2019s death, just like other provisions in a will.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Drafting a pet trust can be free, if you use an <a href=\"https:\/\/adoptagoldenatlanta.com\/wp-content\/uploads\/2021\/01\/animal-care-trust-sample-language-a.pdf\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:online template;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">online template<\/a> and get no legal guidance. The same thing might cost around $100 if you use an online service such as <a href=\"https:\/\/www.legalzoom.com\/articles\/protect-your-prized-pet-create-a-pet-trust\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Legal Zoom;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Legal Zoom<\/a> that provides directions. More commonly, however, pet trusts are part of a broader estate plan, and costs range depending on how complicated your estate is.<\/p>\n<h2 class=\"mb-4 text-xl font-bold md:text-2xl\">When the rich go overboard<\/h2>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">One of the most over-the-top pet trusts came from Leona Helmsley, the New York hotel and real estate mogul known widely as the \u201c<a href=\"https:\/\/nypost.com\/2021\/07\/14\/behind-queen-of-mean-leona-helmsley-a-5b-estate-and-trump\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Queen of Mean;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Queen of Mean<\/a>.\u201d She was famous for her pettiness and tough management style and for landing in prison for tax evasion.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">When Helmsley died in 2007, she left her dog, a Maltese named Trouble who <a href=\"https:\/\/nypost.com\/2005\/01\/28\/leonas-maultese-fierce-attack-by-tiny-dog-suit\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:had reportedly bitten members of her staff;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">had reportedly bitten members of her staff<\/a>, a $12 million trust fund. Most of Helmsley\u2019s estate went to the Helmsley Charitable Trust, but she <a href=\"https:\/\/www.civicresearchinstitute.com\/online\/PDF\/She%20Did%20It%20Her%20Way%E2%80%94Taxes%20or%20No%20Taxes.pdf\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:made individual gifts to several relatives;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">made individual gifts to several relatives<\/a>, and the <a href=\"https:\/\/uniset.ca\/misc\/helmsley_will.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:gift to Trouble;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">gift to Trouble<\/a> was larger than any of those.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The grandchildren, upset that Trouble got more money than they did, took the case to court, where the probate judge was less than impressed by Trouble\u2019s luxury lifestyle and knocked down the amount in trust to $2 million. The other $10 million flowed back <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/137184401\/202530289349100408\/full\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:to her family\u2019s foundation;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">to her family\u2019s foundation<\/a>, where the bulk of the estate went in the first place.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Lesson learned: Your dog can have a trust fund, but don\u2019t go overboard.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Bequests for pets can be challenged \u2013 in which case it\u2019s up to courts to determines how much they think is reasonable for the pet\u2019s need. In Helmsley\u2019s case, $12 million was found to be excessive. And maybe with good reason. Trouble still had a nice life with fewer millions. The dog <a href=\"https:\/\/www.nytimes.com\/2011\/06\/10\/nyregion\/leona-helmsleys-millionaire-dog-trouble-is-dead.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:died in December 2010;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">died in December 2010<\/a> after several years in Sarasota, Florida, at a Helmsley-owned hotel.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Other pet owners who aren\u2019t celebrities have used pet trusts as well, such as <a href=\"https:\/\/www.newschannel5.com\/news\/8-year-old-border-collie-named-lulu-inherits-5-million-in-owners-will\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Bill Dorris;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Bill Dorris<\/a>, a Nashville businessman without any human heirs. He left his dog, Lulu, $5 million.<\/p>\n<h2 class=\"mb-4 text-xl font-bold md:text-2xl\">Pet-loving celebrities who loved all the pets<\/h2>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Finally, there\u2019s a lesson to be learned from British fashion designer and icon <a href=\"https:\/\/www.theguardian.com\/lifeandstyle\/2011\/jul\/26\/alexander-mcqueen-pet-dogs\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Alexander McQueen;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Alexander McQueen<\/a>, who was worth \u00a316 million ($21 million) when he <a href=\"https:\/\/www.nytimes.com\/2025\/09\/04\/style\/luke-newton-alexander-mcqueen-bridgerton.html?searchResultPosition=1\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:died in 2010 at the age of 40;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">died in 2010 at the age of 40<\/a>. McQueen left \u00a350,000 ($66,000) in a trust for his two bull terriers so that they would be well cared for during the remainder of their lives.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">McQueen also included a bequest of \u00a3100,000 ($132,000) to the <a href=\"https:\/\/www.battersea.org.uk\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Battersea Dogs and Cats Home;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Battersea Dogs and Cats Home<\/a> in his will to help fund the care of some of the millions of other animals out there that need the basics of food and shelter.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\"><a href=\"https:\/\/www.americanhumane.org\/about-us\/our-mission\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Animal shelters, in the U.K., the United States;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Animal shelters, in the U.K., the United States<\/a> and other countries, help rescue and protect animals, and these animals need more help than the Choupettes and Troubles of the world.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">So, my advice is that you go ahead and create a pet trust for your cat. But don\u2019t forget to give some money in your will \u2013 and ideally while you\u2019re alive \u2013 to help the vast majority of the <a href=\"https:\/\/www.aspca.org\/helping-shelters-people-pets\/us-animal-shelter-statistics\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:millions of companion animals who need new homes;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">millions of companion animals who need new homes<\/a> every year. None of them have trust funds.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">What becomes of Reggie, Keaton\u2019s golden retriever, and her estate remains to be seen. <a href=\"https:\/\/www.imdb.com\/name\/nm0000473\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Keaton, who starred in;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Keaton, who starred in<\/a> hit movies such as \u201cAnnie Hall,\u201d \u201cReds\u201d and \u201cThe First Wives Club,\u201d isn\u2019t the first celebrity to leave millions of dollars to a pet.
